In the development of evaluation theory, there is a trend of gradual complication through the emergence of new evaluation paradigms, approaches and methods, which proves the constant development of the evaluation theory and its relevance. However, evaluation theory is still full of many unresolved problems. These problems are basically related to the lack of a well-built theoretical framework for evaluation, based on fundamental research on the genesis and evolution of the evaluation theory coupled with the value theory. The purpose of (...) the study is to study the genesis of the evaluation theory in conjunction with the development of the value theory, and the structure of assessment. As a result, It has revealed that the evaluation has a social nature and arose with the emergence of man on Earth; The embryonic genesis, as a theory, was in Antiquity, but the academic evaluation theory was formed only in the 30s of the XX century in economic research. Since the 20th century, there has been a trend of shifting priorities from the value theory to the procedure for evaluating the value, contributing to the emergence of a separate profession of an appraiser. The problem of subjectivization of both the evaluating process and the results of it has been established. The basic structure of the evaluation has been determined. Paper reveals the fact of the complication of the evaluation structure by identifying one more subject of evaluation. The conflict-nature of the evaluation is identified. (shrink)

This paper examines the culture, the dynamics and the financial underpinnings that determine how medical research is being conducted on children in the United States. Children have increasingly become the subject of experiments that offer them no potential direct benefit but expose them to risks of harm and pain. A wide range of such experiments will be examined, including a lethal heartburn drug test, the experimental insertion of a pacemaker, an invasive insulin infusion experiment, and a fenfluramine "violence prediction" experiment. (...) Emphasis, however, is given to psychoactive drug tests because of the inherent ethical and diagnostic problems involved in the absence of any objective, verifiable diagnostic tool. Effort is made to provide readers comprehensive reference sources to evidence-based reports about the serious risks these drugs pose for adults and children so that the reader may judge whether the benefits (if any) outweigh the risks for children. The first ethical issue raised by these experiments is: did the severity of illness in these children justify their exposure to short and long-term risks? The ethics of the experiments will be evaluated by referring to existing codes of medical research ethics-the Nuremberg Code, the Declaration of Helsinki, and the federal Code of Regulations. The thirteen cases presented will demonstrate that children are being used in ever more speculative experiments, often in the absence of a therapeutic intent, but a significant chance for causing harm and / or discomfort. Some of the experiments were designed to explore the mechanisms of pathology and pharmacological interventions, or the response of neurological brain receptors to chemical provocation ("challenge"). Others were designed to test the safety or efficacy of new drugs, even to test these drugs on healthy children who were hypothesized to be "at risk." Children and adolescents have been subjected to "forced dose titration" experiments that induced a spectrum of severe adverse effects, including insomnia, extreme restlessness, agitation, (akathisia) and self-injurious behavior. FDA reports show that suicide is a significant issue in psychotropic drug trials-in pediatric trials the problem is even greater. The paper aims to demonstrate how the enactment of the Better Pharmaceuticals for Children Act (incorporated into the Food and Drug Administration Modernization Act, FDAMA), set in motion a radical shift in public policy by providing huge financial incentives to pharmaceutical companies to test new or patented drugs in children. Federal policy shifted from one aimed at protecting children by setting limits on permissible research risks, to a policy aimed at broadening the inclusion of children as test subjects. It will be shown how the FDA and the Department of Health and Human Services lifted regulatory restrictions to permit research involving greater than minimal risk to be conducted on healthy children, claiming that all children are potentially "at risk" of a future condition. Children were in this way deprived of regulatory protections. An argument will be made that the approval of nontherapeutic, harmful experiments-such as exposure of toddlers to lead poison-under the current gate keeping system raises serious doubts about the sustainability of institutional review boards (IRBs) as protectors of human research subjects. Children, who are precluded from exercising the adult human's right to informed consent, are being exploited as commodities for commercial ends. It is the position of the author that nothing less than the enactment of a federal law mandating a radical overhaul of the current research review system, with independent checks and balances, will provide children the legal protections they need. Ten specific recommendations are offered to protect children from harmful experiments. (shrink)

The replication crisis has spawned discussions on the meaning of replication. In fact, in order to determine whether an experiment fails to replicate, it is necessary to establish what replication is. This is, however, a difficult task, as it is possible to attribute different meanings to it. This paper offers a solution to this problem of ambiguity by engineering a concept of replication that, if compared to other proposals, stands out for being not only broadly applicable but also sufficiently specific. It features a minimal level of operationalism, which would otherwise limit its applicability, while it heavily relies on replication’s specific epistemic functions, which are inter-disciplinary. Another merit is its context sensitivity, which enables it to differentiate instances of replication from non-instances of replication in every scientific discipline according to the discipline’s own standards. Do numbers exist? Carnap (1956 [1950]) famously argues that this question can be understood in an “internal” and in an “external” sense, and calls “external” questions “non-cognitive”. Carnap also says that external questions are raised “only by philosophers” (p. 207), which means that, in his view, philosophers raise ”non-cognitive” questions. However, it is not clear how the internal/external distinction and Carnap’s related views about philosophy should be understood. This paper provides a new interpretation. I draw attention to Carnap’s distinction between (...) purely external statements, which are independent from all frameworks, and pragmatic external statements, which concern which framework one should adopt, and argue that the latter express noncognitive mental states. Specifically, I argue that “frameworks” are systems of rules for the assessment of statements, which are utterances of ordinary language sentences. Pragmatic external statements express noncognitive dispositions to follow only certain rules of assessment. For instance, “numbers exist” understood as a pragmatic external statement expresses a noncognitive disposition to use only rules of assessment according to which numbers do exist. Carnap can thereby be understood as proposing a distinctive form of noncognitivism about ontology that is in some respects analogous to norm-expressivism in metaethics. (shrink)

ABSTRACTPrevious research suggests that labelling emotions, or describing affective states using emotion words, facilitates emotion regulation. But how much labelling promotes emotion regulation? And which emotion regulation strategies does emotion labelling promote? Drawing on cognitive theories of emotion, we predicted that labelling emotions using fewer words would be less confusing and would facilitate forms of emotion regulation requiring more cognitively demanding processing of context. Participants mentally immersed themselves in an emotional vignette, were randomly assigned to an exhaustive or minimal emotion (...) labelling manipulation, and then completed an emotion regulation strategy planning task. Minimal emotion labelling promoted higher subjective emotional clarity. Furthermore, in terms of specific emotion regulation strategies, minimal emotion labelling prompted more plans for problem solving and marginally more plans for reappraisal, but did not affect plans for behav... This essay traces the changing relationship between horticulture, agriculture, and philosophy across the seventeenth century, as the personae of the philosophical husbandman and the philosophical gardener intertwined and competed. At stake in the dynamics between them was the relationship between abstruse researches and practical applications in evolving experimental philosophy, as well as the aesthetic of experimental practices and rhetoric. Early seventeenth-century promoters of colonial projects, such as Virginian sericulture, situated the metropolitan pleasure garden, a place of whimsy and fantastical reasoning, (...) as a realm of trial that presumed eventual utility and application to large-scale husbandry. Such views informed relationships between fanciful trials, speculative proposals, and presumptions of future utility in the development of the persona of the philosophical gardener and attendant notions of experimental philosophy over the course of the century. El presente trabajo lleva a cabo una interpretación conjunta de dos pasajes del diálogo platónico Teeteto (cf. 182d8-e11; 184d1-5). En específico, busca mostrar el trasfondo temporal que yace a la postura de Platón según la cual es necesario que el agente de percepción cumpla un rol unificante, rol sin el cual la propia experiencia perceptiva no podría ser tal como es. Dicho trasfondo temporal consiste, en un caso (cf. 182d8-e11), en mostrar que las percepciones simultáneas necesitan convergen en un “lugar” (...) común que las sintetice, mientras que, en otro caso (cf. 184d1-5), radica en poner de relieve que, a pesar de que la percepción acontece a la manera de un cierto flujo, es menester que en ella haya cierta permanencia, no sólo para que las cosas percibidas muestren alguna estabilidad en el tiempo para uno mismo, sino también para que pueda haber un “sí mismo” al cual esas cosas puedan comparecerle. This is the first monograph devoted to the theology of the Epinomis. It argues that the work offers a revised Platonic conception of the divine better suited to the political imperatives of the post-Classical age. The Epinomis is an 'appendix' to Plato's Laws written by Plato's student, Philip of Opus. Through a comprehensive analysis of the Epinomis' lexicon, and comparisons with the Corpus Platonicum, Vera Calchi offers readers an insight into the Epinomis' philosophical and historical context, purpose, and legacy. (...) Calchi argues that Philip effectively reshapes Plato's metaphysical language into a theology premised on the immanence of God in the heavens. The resulting account of God's providential activity in the cosmos, which offers a new way of thinking about morality and political order, can be regarded as a major step towards the cosmic theology of the Hellenistic period. The Theology of the Epinomis is suitable for students and scholars of ancient philosophy, particularly those working on the Epinomis and Platonic philosophy. One dimension of cognitive success concerns getting it right: having many true beliefs and no false ones. Another dimension of cognitive success concerns using the right concepts. For example, using a concept of a person that systematically excludes people of certain demographics from its extension is a sort of cognitive deficiency. This view, if correct, tasks inquirers with critically examining the concepts they are using and perhaps replacing those concepts with new and better ones. This task is often referred to (...) as “conceptual engineering”. However, so far it is unclear what exactly happens in cases of conceptual engineering. How does language change when we engineer a concept? This article offers an answer. I propose a view on which, when speakers assess the truth of propositions, they often rely on assumptions with regard to what is required for their truth. For example, when speakers assess whether unborn fetuses are people, they rely on assumptions with regard to what is required to be a person. Based on this idea, I develop a model of conceptual engineering according to which speakers “engineer concepts” when they change how they assess the truth of propositions. Most courts around the world have been refusing wrongful life actions. The main argument invoked is that the supposed compensable injury cannot be classified as such, since life is always a blessing no matter how hard and painful it is.In opposition to mainstream scholars and the dominant case law, this article sustains that life must be distinguished from living conditions, the former being the real injury at stake, since some living conditions are so intolerable that in themselves they justify a (...) compensation within wrongful life actions. Lists foreground multiplicity: both of objects to be pursued and, for distant objects, of far-flung networks enabling their pursuit. The future-oriented or projective list stretches such networks not only around the world but forward through time. Research agendas are one kind of future-oriented, projective list. Sketching how such lists have functioned over time, from Francis Bacon's “The New World of Sciences, or Desiderata” to today's desiderata lists, suggests how an early modern model of imperial expansion has shaped, in unintended ways, (...) a scientific rhetoric of collaborative advance on shared targets. Ontological expressivism is the view that ontological existence claims express non-cognitive mental states. I develop a version of ontological expressivism that is modeled after Gibbard’s (2003) norm-expressivism. I argue that, when speakers assess whether, say, composite objects exist, they rely on assumptions with regard to what is required for composition to occur. These assumptions guide their assessment, similar to how norms may guide the assessment of normative propositions. Against this backdrop, I argue that “some objects have parts”, uttered in the (...) context of an ontological disagreement, expresses a noncognitive disposition to assess the truth of propositions by using only rules of assessment according to which the proposition that some objects have parts is to be evaluated as true. Given the growing popularity of online methods for researchers and the increasing awareness of the levels of harassment and abuse directed at women online—especially women expressing feminist views—it is critical that we address the implications of online abuse for feminist researchers. Focussing on an often hidden yet significant part of our methodological decisions and recruitment, this paper details the online abuse levelled by men's rights activists against a research project on women's experiences of men's stranger intrusions in public space. It (...) argues for the need to locate such experiences within a violence-against-women frame, extending the concept of a continuum of sexual violence. Such an extension renders visible the added labour of ‘safety work’, which forms an invisible backdrop to the methodological decisions of many feminist researchers. (shrink)

We show that in the Maxwell–Lorentz theory of classical electrodynamics most initial values for fields and particles lead to an ill-defined dynamics, as they exhibit singularities or discontinuities along light-cones. This phenomenon suggests that the Maxwell equations and the Lorentz force law ought rather to be read as a system of delay differential equations, that is, differential equations that relate a function and its derivatives at different times. This mathematical reformulation, however, leads to physical and philosophical consequences for the ontological (...) status of the electromagnetic field. In particular, fields cannot be taken as independent degrees of freedom, which suggests that one should not add them to the ontology. (shrink)

We study higher analogues of the classical independence number on $\omega $. For $\kappa $ regular uncountable, we denote by $i(\kappa )$ the minimal size of a maximal $\kappa $ -independent family. We establish ZFC relations between $i(\kappa )$ and the standard higher analogues of some of the classical cardinal characteristics, e.g., $\mathfrak {r}(\kappa )\leq \mathfrak {i}(\kappa )$ and $\mathfrak {d}(\kappa )\leq \mathfrak {i}(\kappa )$. For $\kappa $ measurable, assuming that $2^{\kappa }=\kappa ^{+}$ we construct a maximal $\kappa $ -independent (...) family which remains maximal after the $\kappa $ -support product of $\lambda $ many copies of $\kappa $ -Sacks forcing. Thus, we show the consistency of $\kappa ^{+}=\mathfrak {d}(\kappa )=\mathfrak {i}(\kappa )<2^{\kappa }$. We conclude the paper with interesting open questions and discuss difficulties regarding other natural approaches to higher independence. (shrink)

We draw upon the attention-based view of the firm to identify the conditions under which community influentials (CIs) on a board impact a firm’s corporate social performance (CSP). We test our hypotheses with a panel data set of Fortune 500 firms from 2004 to 2008, including 3,955 unique firm–director combinations (aggregated to the board level). Although CIs are often considered less powerful directors, we identify that when the firm is experiencing poor CSP, CIs have a positive effect on CSP. The (...) ability of CIs to influence CSP is also conditional on the access of CIs and other board members to socially oriented board ties. Our article points out that power and influence is contingent on the decision context and the relative knowledge of organizational players, and that players with relatively lower power may improve their status and command attention when they can offer exclusive insight into important issues. Comprehensive regulatory changes brought on by recent corporate governance reforms have broadly redefined and re-emphasized the roles and responsibilities of all the participants in a public company’s financial reporting process. Most notably, these reforms have intensified scrutiny of corporate audit committees, whose role as protectors of investors’ interests now attracts substantially higher visibility and expectations. As a result, audit committees face the formidable challenge of effectively overseeing the company’s financial reporting process in a dramatically changed – and highly charged – (...) corporate governance environment. This paper discusses the new expectations of audit committee responsibilities and effectiveness in the wake of corporate governance reforms, key challenges, “whistleblower” provisions and shortcomings, and provides some directions for future research. The events surrounding COVID-19, combined with the mandatory quarantines widely imposed in Asia and Europe since the virus outbreak, have reignited discussion of the balance between individual rights and liberties and public health during epidemics and pandemics. This article analyses this issue from the perspectives of precaution and necessity. There is a difficult relationship between these two seemingly opposite principles, both of which are frequently invoked in this domain. Although the precautionary principle encourages the use of quarantines, including mandatory quarantines, (...) and associated restrictive measures, the principle of necessity puts a break on such measures. The COVID-19 pandemic reveals once again the different interrelations between these two principles. However, the alleged conflict between the PN and the PP is based on a superficial analysis. The relation between these two principles is far more complex, as this article will demonstrate. (shrink)

We study two ideals which are naturally associated to independent families. The first of them, denoted \, is characterized by a diagonalization property which allows along a cofinal sequence of stages along a finite support iteration to adjoin a maximal independent family. The second ideal, denoted \\), originates in Shelah’s proof of \ in Shelah, 433–443, 1992). We show that for every independent family \, \\subseteq \mathcal {J}_\mathcal {A}\) and define a class of maximal independent families, to which we refer (...) as densely maximal, for which the two ideals coincide. Building upon the techniques of Shelah we characterize Sacks indestructibility for such families in terms of properties of \\) and devise a countably closed poset which adjoins a Sacks indestructible densely maximal independent family. The Director-General of the WHO has suggested that China’s approach to the COVID-19 crisis could be the standard of care for global epidemics. However, as remarkable as the Chinese strategy might be, it cannot be replicated in other countries and certainly not in Europe. In Europe, there is a distribution of power between the European Union and its member states. In contrast, China’s political power is concentrated in the central government. This enables it to take immediate measures that affect the (...) entire country, such as massive quarantines or closing borders. Moreover, the Chinese legal framework includes restrictions on privacy and other human rights that are unknown in Europe. In addition, China has the technological power to easily impose such restrictions. In most European countries, that would be science fiction. These conditions have enabled China to combat epidemics like no other country can. However, the WHO might have been overoptimistic. The Chinese standard of care for treating COVID-19 also raises problematic issues for human rights, and the real consequences of these actions remain to be seen. (shrink)

The defense of necessity, also known as the “choice of evils,” reflects popular moral intuitions and common sense: sometimes, breaking the rules is the right—indeed, the only—thing to do in order to avoid a greater evil. Citing a classic example, mountain climbers may break into a cabin to wait out a deadly snow storm and appropriate the owner’s provisions because their property violations are a lesser evil compared to the loss of life. At the same time, this defense contradicts the (...) fundamental principles of criminal responsibility in that it authorizes violation of rights of innocent bystanders. By allowing the mountain climbers to override the property rights of the cabin owner, the defense effectively forbids the cabin owner to use force in response—a different rule would perpetuate violence. This outcome is at odds with the basic criminal law doctrines. There is no general duty to rescue in Anglo-American law. Yet, by forbidding the cabin owner to use force, the defense of necessity essentially imposes on him the duty to forego his interests in favor of those of the mountain climbers. The paper explores the origins and boundaries of the defense of necessity. It argues that the existing public and private theories of necessity are unsatisfactory and concludes that a viable theory of necessity should be able to explain why it is sometimes permissible to override individual rights of citizens without their consent or fault. A definition of a property P is impredicative if it quantifies over a domain to which P belongs. Due to influential arguments by Ramsey and Gödel, impredicative mathematics is often thought to possess special metaphysical commitments. It seems that an impredicative definition of a property P does not have the intended meaning unless P already exists, suggesting that the existence of P cannot depend on its explicit definition. Carnap (1937 [1934], p. 164) argues, however, that accepting impredicative definitions amounts to (...) choosing a "form of language" and is free from metaphysical implications. This paper explains this view in its historical context. I discuss the development of Carnap’s thought on the foundations of mathematics from the mid-1920s to the mid-1930s, concluding with an account of Carnap’s (1937 [1934]) non-Platonistic defense of impredicativity. This discussion is also important for understanding Carnap’s influential views on ontology more generally, since Carnap’s (1937 [1934]) view, according to which accepting impredicative definitions amounts to choosing a "form of language", is an early precursor of the view Carnap presents in "Empiricism, Semantics and Ontology" (1956 [1950]), according to which referring to abstract entities amounts to accepting a "linguistic framework". Quando, nel 1935, venne pubblicato il famoso articolo chiamato poi “EPR Paper” per le iniziali dei suoi autori - Einstein, Podolsky, Rosen -, la comunità scientifica dovette confrontarsi non solo con le manifeste provocazioni che il suo argomento voleva mostrare, ma anche con latenti problemi che sarebbero sbocciati più avanti in tutti i loro stridenti contrasti. L’incompletezza della meccanica quantistica, che l’“articolo EPR” si proponeva di dimostrare, poggiava infatti su un principio molto problematico, quello della località, che sarebbe esploso nell’esperimento (...) prima concettuale di Bohm e poi sperimentale di Aspect. Ciò che questo articolo vuole delineare è lo sviluppo del problema della nonlocalità, dai suoi albori fino alla prova della sua effettiva esistenza nel mondo quantistico, dove, come ben ha dimostrato Bell, nulla possono fare le variabili nascoste per dissolvere la realtà nonlocale di alcuni fenomeni. La influencia de la microbiota en el comportamiento, la percepción y diversas facultades cognitivas se ha estudiado en diferentes especies, incluidos el humano. Mas directamente se observa por alteraciones en la microbiota intestinal de pacientes con enfermedades neuropsiquiátricas. Los aportes que el estudio de signos y significado enriquecen la información producida por la metagenómica. Este trabajo presenta una introducción al tema de la microbiota/microbioma desde la biosemiótica, usando la teoría del Umwelt y el circulo funcional Uexkülliano como plataforma, no porque (...) sean las únicas, sino por ser parte de los pilares de esta disciplina.
